1. DWI (first offense) – Class B Misdemeanor
Requires a .08% blood alcohol level, and/or impairment to any degree from alcohol and/or drugs.
Penalties include: Minimum fine of $500.00 (plus a 24% penalty assessment), and 9 months up to 2 years loss of license, completion of a substance abuse screening within 14 days, and to complete any recommendations made by your Impaired Driver Care Management Program (IDCMP), and a $125.00 reinstatement fee at the time your license is restored (plus additional suspension period under the DMV ALS rules)
2. Aggravated DWI – Class A Misdemeanor
Requires a .16% blood alcohol level (or other factors such as excessive speed, and attempts to elude police while under the influence of alcohol, or having a passenger who is a minor).
Penalties Include: Minimum fine of $750.00 (plus a 24% penalty assessment; license loss for 18 months up to 2 years (may petition the Court to reduce to 12 months) after completion of the IDCMP alcohol program. Minimum 5 days in the House of Correction with some additional suspended time, followed by a substance abuse assessment and completion of your service plan as developed by the IDCMP. Installation of an ignition interlock device upon restoration of your license.
3. DWI, 2nd, or subsequent offense – Class A Misdemeanor
Requires a prior conviction of DWI within the last 10 years.
Penalties Include: Minimum fine of $750.00 (plus a 24% penalty assessment; loss of license for 3 years, minimum. a. If prior conviction within 2 years, 60 days House of Correction sentence including the substance abuse evaluation and completion of a service plan developed with your IDCMP, and installation of an ignition interlock device.
b. If prior conviction more the 2 years old, but within the last 10 years, must serve 5 days in the House of Correction and complete a substance abuse evaluation and complete a service plan as developed with your IDCMP, and installation of an ignition interlock device.
4. Felony Aggravated DWI
Typically an accident resulting with serious bodily injury, or many prior convictions.
- Minimum fine of $1000.00 (plus a 24% penalty assessment).
- Potential NH State Prison Sentence and indefinite loss of license.
